1.1 This Terms of Service agreement ("Agreement") constitutes a legally binding contract between Winnine Pacific Pty Ltd ("Company", "we", "us") and you ("You" or "User"). By accessing or using any game, web portal, platform, or interactive application provided by Winnine Pacific ("Services"), you acknowledge that you have read, understood, and agreed to be bound by this Agreement.
1.2 Winnine Pacific reserves the right to modify or amend these Terms at any time at its sole discretion. It is your responsibility to review these Terms periodically. Continued use of the Services following modifications constitutes binding acceptance of the revised provisions. If you do not accept these Terms, you must discontinue using the Services and terminate any registered accounts immediately.
1.3 In the event of a breach of this Agreement, Winnine Pacific reserves the right to issue official warnings, suspend, or permanently terminate any or all accounts registered by you without prior notice or liability.
1.4 You represent that you are at least 13 years of age. If you are between the ages of 13 and 18, you represent that your legal guardian has reviewed and consented to this Agreement on your behalf.
2.1 All assets, visual interfaces, graphics, game designs, software code, multimedia content, sound recordings, animations, and documentation comprising the Services are protected by copyright, trademark, and intellectual property laws of Australia and international treaties.
2.2 You agree not to copy, reproduce, distribute, display, transmit, sell, license, decompile, or exploit any portion of the service content without express written consent from Winnine Pacific, excluding content rightfully uploaded by you.
2.3 Limited License: Winnine Pacific grants you a personal, non-exclusive, non-transferable, revocable, and limited license to access and play our games or utilize our platform solely for non-commercial entertainment purposes strictly under the terms of this Agreement.
3.1 You acknowledge that you transmit or publish content through our communication systems voluntarily. You are solely responsible for any text, media, screenshots, or profile details that you submit, upload, or make accessible on the Services.
3.2 Winnine Pacific does not actively verify the integrity, accuracy, or quality of User Content and assumes no liability for errors, omissions, or damages resulting from user submissions.
3.3 Winnine Pacific reserves the unilateral right to monitor, review, filter, or permanently remove any user submission from the platform at any time with or without prior notice.
4.1 The Services may offer virtual currencies, points, or virtual tokens ("Virtual Currency") acquired using real-world funds. Virtual assets represent a limited, personal license and have no cash value outside our games.
4.2 Virtual Currency and in-game items cannot be redeemed for legal tender, real-world goods, or monetary value from Winnine Pacific or third parties. All acquisitions are final and strictly non-transferable.
4.3 Unauthorized Trading: Selling, purchasing, or trading virtual items or accounts on third-party marketplaces outside the official Services is strictly prohibited and results in immediate account forfeiture.
You agree to comply with all applicable local, national, and international laws. When accessing our communication channels (chats, forums, team boards), you agree not to engage in:
- Posting obscene, offensive, hateful, defamatory, sexually explicit, or abusive messages.
- Harassing, stalking, threatening, or impersonating other users, staff, or enterprise representatives.
- Transmitting viruses, worms, malware, or destructive code designed to disrupt system infrastructure.
- Infringing intellectual property, copyright, patent, trademark, or personal privacy rights.
- Harvesting or attempting to extract credentials, passwords, or security keys of other players.
- Submitting fraudulent reports or misusing customer support ticket systems.
- Developing, sharing, or deploying automation scripts, bots, macro software, or cheating tools.
- Exploiting system bugs, memory glitches, or game architecture errors for unfair competitive advantage.
6.1 "As-Is" Basis: The Services are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including merchantability, fitness for a particular purpose, or uninterrupted availability.
6.2 Exclusion of Damages: In no event shall Winnine Pacific, its directors, employees, or partners be held liable for indirect, incidental, punitive, or consequential damages (including loss of profits, gameplay progress, or data) arising from your access to or inability to access the Services.
6.3 Indemnification: You agree to indemnify and hold harmless Winnine Pacific and its personnel against any claims, liabilities, damages, and legal expenses arising from your violation of this Agreement or infringement of third-party rights.
To mitigate unauthorized activity and payment fraud, our transaction terms are strictly enforced:
FINALITY All completed payments for in-game packages, passes, and virtual currencies are final, fully earned, and non-refundable.
NO CASH VALUE Account balances, reward points, and virtual inventory cannot be converted into cash refunds under any circumstances.
COMPROMISED PAYMENT If your payment instrument is compromised externally, legal recourse must be directed toward the unauthorized party; Winnine Pacific assumes no liability for external instrument compromise.
8.1 Governing Law: This Agreement and any dispute arising from your use of the Services shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles.
8.2 Statute of Limitations: Any cause of action brought by you arising out of or related to the Services must commence within one (1) year after the cause of action accrues; otherwise, it is permanently barred.
